Terms of Service

These Terms of Service govern your access to and use of ButterKey. By accessing or using ButterKey, you agree to these Terms. If you do not agree, do not use the service.

1. The service

ButterKey is an AI gateway that routes your requests to third party AI model providers through a single unified API. ButterKey is an intermediary. We do not create, own, operate, or control the underlying models or the content they generate, and we do not endorse any output. The models, providers, features, and pricing available through ButterKey may change, be limited, or be removed at any time without notice.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use ButterKey. You agree to use the service only in compliance with these Terms and all applicable laws.

3. Accounts and API keys

You are responsible for your account, your API keys, and all activity that occurs under them, whether or not authorized by you. You agree to keep your credentials secure and to notify us promptly of any unauthorized use. We are not liable for any loss arising from unauthorized use of your account or keys.

4. Acceptable use

You agree not to use ButterKey to:

violate any law or regulation, or infringe the rights of others;
generate or distribute unlawful, harmful, deceptive, or infringing content;
reverse engineer, scrape, overload, disrupt, or circumvent any part of the service or its security;
resell, sublicense, or use the service to build a competing product; or
violate the terms, usage policies, or acceptable use policies of any underlying model provider.

You are solely responsible for your inputs and for complying with the policies of each model provider whose models you access.

5. Third party models and outputs

Outputs are generated by third party models and may be inaccurate, incomplete, biased, offensive, or otherwise unsuitable. We do not warrant the accuracy, quality, reliability, or fitness of any output. You are solely responsible for evaluating outputs and for any use you make of them. You must not rely on outputs for professional, legal, medical, financial, safety critical, or other high risk decisions.

6. Fees and billing

ButterKey is offered on a pay as you go basis. You pay only for the usage you incur, and prices may change at any time. You are responsible for all charges incurred under your account. Except where required by applicable law, all payments and credits are non refundable.

7. Availability

The service is provided on an "as is" and "as available" basis. We do not guarantee that the service will be uninterrupted, timely, secure, or error free, and we make no commitment as to the uptime, latency, or availability of any model, provider, or feature.

8. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUTTERKEY AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US IN THE THREE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS.

10. Indemnification

You agree to indemnify and hold harmless ButterKey and its owners, employees, and suppliers from any claims, damages, liabilities, and expenses arising out of your use of the service, your inputs or outputs, your violation of these Terms or any law, or your infringement of the rights of any third party.

11. Suspension and termination

We may suspend or terminate your access to the service at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, your right to use the service ends immediately.

12. Changes

We may modify the service or these Terms at any time. Changes are effective when posted. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which ButterKey is established, without regard to conflict of law principles, and you agree to the exclusive jurisdiction of the courts located there.
